REVIEW  THE STATE ENVIRONMENTAL PLANNING POLICY (MINING, PETROLEUM PRODUCTION AND EXTRACTIVE INDUSTRIES) 2007

 

 

The NSW Department of Planning and Environment undertook a review of the State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) 2007. That review reported back in July and changes were made to the State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) 2007 which took effect on 2nd September 2015.

 

The State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) 2007

The State Environmental Planning Policy (SEPP) is an environmental planning instrument and provides a policy framework to govern the assessment and development of the state’s mineral and energy resources through the planning system.

 

It regulates the permissibility of mining, petroleum production and extractive industries across the state and provides consent authorities with a framework of matters that must be considered in the assessment process.

 

The Review

 

The Review was conducted by the NSW Department of Planning and Environment and principally looked at the operation of clause 12AA of the SEPP.

 

Clause 12AA in its original form directed the consent authority to consider the relative significance of the resource, including the economic benefits of developing the resource, in determining an application for development for the purposes of mining. It did not relate to applications for the development of petroleum gas production. In addition, clause 12AA made the significance of the resource the principal consideration of the consent authority.

 

The Review concluded that while this clause operated within the context of the planning system as a whole, and that other considerations such as the public interest and environmentally sustainable development were being given equal weight, there was still community and stakeholder concerns about an imbalance.

 

The Review recommended, and the NSW Government accepted, that clause 12AA of the SEPP should be repealed.

After further community consultation the NSW government announced the State Environmental Planning Policy (Mining, Petroleum Production and Extractive Industries) 2007 would be amended to repeal clause 12AA.

The new SEPP came into effect on 2nd September 2015.
